1. Acceptance

By accessing or using the pinayum.cc website (collectively, including all content, uploads, and user submissions available through pinayum.cc, referred to as the “Website”), you agree to be bound by these Terms of Service, the Privacy Policy incorporated herein, and all future amendments (collectively, the “Agreement”). In addition to the prohibitions in Section 4, you agree not to upload or share:

– Non-consensual content, including revenge porn or content obtained without the explicit consent of all parties involved.
– Deepfakes or AI-generated content that depicts real individuals without their consent or that violates intellectual property rights.
– Content involving child exploitation, in compliance with Republic Act No. 9775 (Anti-Child Pornography Act of 2009) and other applicable Philippine laws.
– Content that violates Republic Act No. 10175 (Cybercrime Prevention Act of 2012), including cybersex involving minors or non-consensual acts.

pinayum.cc employs content moderation practices, including automated and manual reviews, to ensure compliance. Users must provide proof of age and consent upon request. Violations may result in immediate account termination and reporting to authorities.

8. DMCA Notice and Procedure for Reporting Copyright Infringements

If you believe that material located on or linked to by pinayum.cc violates your copyright, you are encouraged to notify pinayum.cc in accordance with the Digital Millennium Copyright Act (DMCA). pinayum.cc will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material.

To file a copyright infringement notification, please send a written communication that includes the following:

– A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest.

10. Disclaimer of Warranties

11. Limitation of Liability

13. Termination

pinayum.cc may terminate your access to all or any part of the Website at any time, with or without cause, with or without notice, effective immediately.

14. Governing Law

These Terms of Service and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

15. Data Privacy

pinayum.cc complies with Republic Act No. 10173 (Data Privacy Act of 2012) and its implementing rules and regulations. Your personal data is processed in accordance with our Privacy Policy, which details how we collect, use, store, and protect your information. By using the Website, you consent to such processing.

16. Miscellaneous
